Welcome to Botive AI (“we”, “our”, or “us”). By using our website botive.ai and chatbot services (the “Service”), you agree to be bound by the following Terms of Service (“Terms”). If you do not agree with these Terms, please do not use our Service.

1. Use of Service

You may use the Service only in compliance with these Terms and all applicable laws. By creating an account, you represent that you are at least 18 years old or the legal age of majority in your jurisdiction.

2. Free Plan

We offer a free plan that includes:

  • 1 chatbot for 1 website
  • Unlimited messages
  • No credit card required

This plan is ideal for individuals or small businesses and is subject to fair use limitations.

3. Paid Plan

You can upgrade to a paid plan to:

  • Add additional websites at $20/month per websit
  • Or save 20% with annual billing ($192/year per website)

All payments are securely processed by Paddle.com, our authorized reseller and Merchant of Record. By subscribing to a paid plan, you agree to Paddle’s billing terms and conditions.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and all activity under your account. You must notify us immediately if you suspect unauthorized use.

5. User Content

You retain all rights to any content (FAQs, documents, instructions) you upload to train your chatbot. By uploading content, you grant us a limited, non-exclusive license to use that data for the purpose of providing and improving the Service.

You agree not to upload or use the Service to distribute:

  • Illegal, abusive, or harmful content
  • Malware or malicious scripts
  • False or misleading information

We reserve the right to suspend or terminate accounts violating these terms.

6. Cancellation & Termination

You may cancel your account at any time through your dashboard or by contacting us. Upon cancellation:

  • Free plans remain active.
  • Paid subscriptions will not renew at the end of the current billing cycle.

We reserve the right to suspend or terminate your access if we detect abuse or violations of these Terms.

7. Refund Policy

We offer refunds according to our Refund Policy. Please read it carefully before making a purchase.

8. Service Availability & Updates

We strive to keep the Service online and functional at all times. However, we may:

  • Make updates or improvements
  • Suspend services for maintenance
  • Modify features

We are not liable for any loss or damage resulting from temporary unavailability.

9. Limitation of Liability

To the fullest extent permitted by law, Botive AI and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use or inability to use the Service.

Our total liability for any claims under these Terms shall not exceed the amount paid (if any) for the Service in the last 12 months.

10. Intellectual Property

All content, branding, and technology used in the Service are the property of Botive AI or its licensors. You may not copy, modify, or distribute any part of the Service without our written permission.

11. Changes to the Terms

We may update these Terms from time to time. When we do, the updated Terms will be posted on our website with the new “Effective Date.” Continued use of the Service means you accept the updated Terms.

12. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of USA, without regard to its conflict of law principles.
